With the approval of the courts, many employers are now able to compel employees to agree to alternative dispute resolution as a condition of employment. My employment practice is still growing, and I do not foresee a decline in either employment mediation or arbitration. It will be interesting, however, to see how dispute resolution evolves in a post-pandemic world. For three years, all of my cases were virtual. Parties and neutrals alike learned that hearings and mediations could be conducted effectively online, and today, even as Covid cases decline, many parties still are comfortable presenting their cases on Zoom. Other parties, however, are eager to meet in person, regardless of the time and cost involved, especially for mediation. Going forward, I think that parties will be selective as to how they mediate and arbitrate and will use both online and in-person procedures, depending on the particular issues in dispute and the personalities involved. In 2016, I was awarded the Peggy Browning Award for outstanding work in resolving conflicts in the labormanagement community in the Mid-Atlantic region of the United States. In 2019, Cornell University awarded me the Judge William B. Groat Award for distinction in my career as an arbitrator and mediator. USA “The range of disputes that I handle is substantial.
